These terms govern your use of kafasupply.com and any order you place with us. Please read them before ordering. By placing an order you accept these terms.
These terms are provided in good faith and in plain language. They are not a substitute for legal advice, and nothing here removes rights you have under applicable state or federal law.
1. Who you are contracting with
This website is operated by KAFA Commerce LLC, a limited liability company registered in the State of Florida, trading as KAFA Supply Co. References to "we", "us" and "our" mean KAFA Commerce LLC.
2. Orders
An order placed through this website is an offer to buy. It is accepted only when we send you a dispatch confirmation. Until then we may decline the order, in whole or in part, for any reason, including unavailability of stock or an error in the listing.
3. Pricing and errors
Prices are shown in US dollars and exclude sales tax, which is applied where required at checkout. We take care to price correctly, but if an item is listed at an obviously incorrect price we are not obliged to supply it at that price. We will contact you and offer the correct price or a full refund.
Prices may change without notice. The price that applies is the one shown at the time your order is accepted.
4. Product information
Product descriptions, specifications and images are provided as a guide. Manufacturers change specifications and packaging without notice. Where a specification is critical to your purchase, contact us to confirm before ordering.
5. Payment
Payment is taken at the time of order unless you hold an approved account with agreed terms. Title in the goods passes to you on full payment. Risk passes to you on delivery.
6. Delivery
Delivery is governed by our delivery information, which forms part of these terms. Delivery estimates are estimates, not guarantees.
7. Returns
Returns are governed by our returns and cancellations policy, which forms part of these terms.
8. Warranties
Products are covered by the manufacturer's warranty where one is offered. We pass on the benefit of that warranty to you. We do not give any additional warranty of our own beyond the return rights set out on this site and any rights you have by law.
9. Limitation of liability
To the extent permitted by law, our liability arising out of any order is limited to the amount you paid for the goods concerned. We are not liable for indirect or consequential loss, including loss of profit, loss of contract or downtime. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence.
10. Safe use of tools
Power tools and equipment are dangerous if misused. You are responsible for reading the manufacturer's instructions, using appropriate protective equipment and ensuring the operator is competent and, where required, licensed or certified. We do not provide training and we are not responsible for injury or damage arising from use of the products we supply.
11. Intellectual property
The design, text and artwork on this site are ours or used with permission. Manufacturer names, model numbers and trademarks referred to on this site remain the property of their respective owners and are used to identify the products described.
12. Governing law
These terms are governed by the laws of the State of Florida. Any dispute is subject to the courts of Pinellas County, Florida.
13. Changes
We may update these terms. The version that applies to your order is the version published when the order was placed.
